OPPO FIND N2 FLIP T’s and C’s
Please read the terms and conditions as set out in this document pertaining to the launch of OPPO Find N2 Flip carefully. Participation in this Promotion will constitute your acknowledgment and consent to comply with the terms and conditions as set out in this Rule. If you do not agree with these terms and conditions, please do not participate in this Promotion. This Promotion is only available while stock lasts.
1.1 In this document, unless the context clearly indicates a contrary intention, the following terms shall have the meaning as defined in this clause apply:
(a) “Business Day” means a day other than a Saturday or a Sunday or a day which from time to time is a proclaimed public holiday in the Republic of South Africa;
(b) “CPA” means the Consumer Protection Act, 68 of 2008;
(c) “Offer” means 1 x OPPO Find N2 Flip Strap case and 1 x OPPO Enco Air 2 Pro Buds as more fully set out in clause 6 below;
(d) “Participant” means an individual who enters the Promotion and meets the criteria set out in any natural person who qualifies in terms of clause 4.1;
(e) “POPI” means the Protection of Personal Information Act, No 4 of 2013;
(f) “Period” means the period starts on 00:00 1 April 2023, and closes at 23:59 on 30 April 2023, or any such longer period as may be announced by the Promoter in its sole and absolute discretion.
(g) “Promoters” means, OPPO South Africa;
(h) “Promotion” means the promotional campaign to which the Rules pertain as run by the Promoter during the Period; and
(i) “Rules” means the rules contained in this document, as required by Section 36 (3) (c) of the CPA; and
2.1 This Promotion is organized by the Promoters where all qualifying Participants can redeem the Offer by purchasing or upgrading to an OPPO Find N2 Flip(“Qualifying Device”) under the terms and conditions as set out in this Rule.
3.1 This Rule is a public document and may also be made available upon request.
3.2 By entering into the Promotion, the Participants agrees and acknowledges that he/she has read and understand the Rules as the Rules contain certain terms and conditions which may:
(a) limit the risk or liability of the Promoters, or any relevant third party; and/or
(a) create risk or liability for the Participant; and/or
(b) compel the Participant to indemnify the Promoter or a relevant third party; and/or
(b) serve as an acknowledgement by the Participant of certain facts.
3.3 Notwithstanding anything contrary as set out in this Rule, to the extent that this Rule or any goods or services provided under this Rule are governed by the CPA, no provision of the Rule are intended to contravene the applicable provisions of the CPA, and therefore all provisions of this Rule must be treated as being qualified, to the extent necessary, to ensure that the applicable provisions of the CPA are complied with.
4.1 All Participants must:
(a) be citizens or holder of legal permit for residence of the Republic of South Africa; and
(b) be currently residing in the Republic of South Africa at the date of the commencement of the Period; and
(c) be a natural person and be at least eighteen (18) years old at the date of the commencement of the Period; and
(d) be in the possession of a valid South African identity document at the time of the redemption of the Offer.
4.2 Participation in this Promotion excludes the Promoter, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with the Campaign and their spouses, life partners, parents, children, siblings, business partners or associates (“Associates”), unless such Associates purchased a Qualifying Device in their own name and for their own personal use, then in such an instance an Associate will be entitled to participate in the Promotion.
4.3 The Participant, by entering into the Promotion, expressly acknowledges that he/she has been given an appropriate opportunity to first read the Rules before entering the Promotion and that he/she understands and thereby agrees to the Rules.
[b]5. HOW TO PARTICIPATE[/b]
5.1 In order to participate the Promotion, Participants must:
(a) purchase or upgrade to a Qualifying Device with a valid IMEI number from an OPPO authorized network operator, retail outlet or online within the Republic of South Africa during the Period in his/her own name and for their own personal use; and
(b) be in the possession of a valid proof of purchase of the Qualifying Device with verifiable details such as IMEI number and outlet from which his/her Qualifying Device was purchased from.
[b]6. OFFER AND REDEMPTIION[/b]
6.1 For Qualifying Device with the Participant purchases, he/she is entitled to redeem 1 x Offer. ONLY 1 Offer may be redeemed per IMEI number.
6.2 All redemption for Offer must be submitted within the Period, no late submission will be accepted for whatsoever reason.
6.3 To redeem the Offer, the Participant must follow the following steps and/ or instructions:
(a) Purchase and Qualifying Device which the Participant bought or upgraded, which Qualifying Device must be purchased from any OPPO authorized network operator, participating retail outlet, OPPO e-Store or online within the Republic of South Africa during the Period.
(b) Log on to the redemption platform at: www.opporewards.co.za (“Platform”)
(c) Insert the following details as required on the Platform:
– name and surname
– email address
– contact number
– ID number
– SIM 1 IMEI number
– Delivery address
– Picture of proof of purchase
(d) Once the Promoter has validated the Participant’s online details and proof of purchase of the Participant’s Qualifying Device, Promoter will inform the same to the Participants through email or sms.
6.4 Participants who encounter any technical issues when redeeming the Offer, can email support at firstname.lastname@example.org
6.5 The Promoter accepts no responsibility for entries lost, misdirected, illegible, late, mutilated or altered. Entries that do not comply with these Rules will be disqualified.
6.6 Errors and omissions may be accepted at the Promoter’s sole discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those right.
6.7 It is the Participant’s responsibility to ensure that any information provided to the Promoter is true, accurate, complete, and up to date.
6.8 The Participant will be required to provide the Promoter with a daytime address to enable delivery of the Offer.
6.9 The Promoter will not be responsible for any costs associated with the redemption process of the Offer.
6.10 Should there be any dispute pertaining to the validation process arising from whatsoever reason, the Promoter shall be sole adjudicator of the dispute and the Promoter’s decision shall be final.
[b]7. TERMS OF DELIVERY[/b]
7.1 It will take approximately between 48 to 72 working hours for the Promoter to validate an entry into the Promotion. Delivery of Promotion Reward will be within 14 to 30 Business Days from date of redemption.
7.2 Participants acknowledge and accept that the Promoter utilizes a third-party agent to contact the Participant to arrange delivery. To affect the contacting and delivery process, the Promoter shall provide the Participant’s information to such third-party agent.
7.3 Delivery of the Offer will take place in accordance with Covid-19 regulatory requirements (if any) and on receipt of the Participant’s valid and correct delivery details supplied by the Participant through the Platform.
7.4 Should the Participant fail to supply correct and valid delivery details upon redemption of the Offer through the Platform, the Offer will be forfeited.
7.5 Delivery of the Offer will occur by way of courier and the Promoter does not accept any responsibility for late/non arrivals and/or any damage to the Offer that may arise during its delivery to the Participant.
7.6 In the event that the Participant is unreachable or fails to claim delivery of the Offer after 2 (two) attempts to deliver over a period of 10 (ten) working days it shall be forfeited.
7.7 The Participant must present a valid identity document at the time of delivery in order to receive the offer.
7.8 Deliveries will only be made within the borders of the Republic of South Africa.
7.9 Deliveries will occur from Monday to Friday during regular office hours (08h00 to 17h00) and no deliveries will be made on public holidays or over the weekends. Delivery of the Offer may be delayed due to South African Government regulations imposed as a result of the Covid-19 pandemic.
7.10 The Promoter accepts no liability or responsibility, whether occasioned by any circumstance not foreseeable and not within its reasonable control for late or delayed delivery of the Offer owing to, but not limited to, stock unavailability, strike, lock out, destruction of the Offer on route by any means, any civil commotion or disorder, riot, threat of war, any action taken by governmental authority (including Government regulations imposed as a result of the Covid-19 pandemic) or public authority of any kind, fire, explosion, storm, flood, earth quake or other acts of God.
8.1 In addition to what’s contained in the Rule, Participants’ attention is draw to the following:
(a) the Participants must provide correct and up-to-date personal details as required by the Promoter and allow the Promoter to process (as defined in POPI) such information in terms of POPI;
(b) the Promoter reserves the right to unilaterally amend or terminate this Rule at any time, with or without reasons, at their sole and absolute discretion. In such event, where the Promotion is terminated or suspended, all Participants agree to waive any rights that they may have pertaining to the Promotion and acknowledge that they have no recourse against the Promoter, their employees, agents, partners, suppliers, or sponsors;
(c) in the event of a dispute, the decision of the Promoter will be final and binding and no correspondence will be entered into. In this regard and for further clarity, the Promoter shall be entitled to deal with such disputes (or any failure by Participants to follow the rules) in such manner and/or forum at their sole discretion, including that the Promoter shall be entitled to immediately disqualify Participants, with or without reason, from the Promotion; and
(d) Unlawful, fraudulent, or otherwise dishonest conduct or any conduct in breach of these Rules by a Participant and/or their parents/guardians, determined in the Promoter’s sole discretion, will result in disqualification from the Promotion and ineligibility to redeem any Offer;
(e) information regarding the Promotion that is published on authorized advertising material will also form part of the terms and conditions of the Promotion.
(f) If part or all of any clause of these Rule is illegal, invalid or unenforceable:
– It will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible; and
– It will be severed from these Rules and the remaining provisions of these Terms and Conditions will continue to have full force and effect
9.1 By entering the Promotion, the Participant expressly agrees to the following indemnifications:
(a) the Participant indemnifies and holds harmless the Promoter and its promotional partners, their employees and their agents (“the Indemnified Parties”) of any and all liability pertaining to any damage, cost, injuries and losses of whatsoever nature and howsoever arising as a result of their participation in the Promotion and related events and activities, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy; and
(b) the Participant accepts that the Indemnified Parties will not be responsible for any costs, damage or otherwise, howsoever incurred by the Winner subsequent to redeeming the Offer.
9.2 To the extent permitted by CPA and any other applicable law:
(a) The participant hereby indemnifies the Promoter against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the Participants participating in the Promotion.
(b) The Promoter excludes all warranties (express or implied), representations and liabilities regarding this Promotion (other than for death or personal injury caused by its negligence and/or fraud).
(c) Data charges may be incurred by the Participant during the redemption process of the Offer and the Promoter will not be responsible for any such costs.
(d) Network rates apply.
10.1 Any personal data relating to the Participant will be used solely in accordance with CPA and POPI and will not be disclosed to a third party without the Participant’s prior consent.
10.2 This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network.
10.3 The Participant by part taking in the Promoter consents to his/her personal information to be shared with the Promoter’s employees, contractors or agents for the purpose of this Promotion and for the purpose of sharing future promotions.
